A Questionable Claim - Successfully Defended

Client: A large producer and installer of kitchens, bedrooms and bathrooms

Claim: Fractured skull (up to £95,000 just for the PI part, could be additional for lost wages, injury to feelings etc)

Situation: The client used a contract cleaner at their site. She was cleaning the kitchen and claimed there was water leaking from the water chiller. She continued to clean the kitchen and then walked back over the water where she says she slipped and was injured.

She had one day off work, and when she returned was questioned about why if she had spotted the hazard, she didn't resolve it right away. This wasn't well received, and the next day the company received a letter saying that the cleaner wasn't coming in which was followed by a letter from a PI solicitor claiming for injury damages.

The EHS Manager said that he has good records himself and could find no evidence of water being on the floor, or a leak in the chiller. These records were manual and took around one week to collate and present to the insurer. However, the insurer said it wasn't worth the fight and they should settle. NB the insurer fully insures the client, with zero deductible, so all costs would have been the insurer's.

Impact of iAuditor: The EHS Manager remembered that the cleaning contractor sends him regular iAuditor reports about the work they do. He was able to review them all and found no evidence of any leak or fault with the water machine and when they inspected the machine it was fully functional. The insurer said that this was the evidence they needed to defend the claim. They sent the evidence to the law firm who is no longer pursuing the case.

I hope this is useful and gives context to a real live use case that has saved not just c. £100k but also saved management time, protected the customer's premium for next year, and protected their reputation.
